The undersigned, as a participant in the Pasko Expo,  Phase1 Entertainment agrees to indemnify and hold the Pasko Expo, Phase1 Entertainment, and any and all agents and employees of these entities, free and harmless from any and all claims, liability, loss, damage, or expenses resulting from the undersigned’s participation in the Pasko Expo and the undersigned’s use and occupation of any facilities provided as a result of the undersigned’s participation; specifically, including without limitation any claim, liability, loss, or damage arising by reason of:

1. The death or injury of any person or persons, including the undersigned or any person who is an employee or agent of the undersigned, or by reason of the damage to or destruction of any property including property owned by the undersigned or any person who is an employee or agent of the undersigned, and caused or allegedly caused by some act or omission of the undersigned or of an agent, contractor, employee, servant, sub-lessee, or concessionaire of the undersigned; or
2. The undersigned’s failure to perform any provision of the agreement for participation in the Pasko Expo or to comply with any requirement of law or any requirement imposed on authorized governmental agency or political subdivision.
3. I have read and fully understand the terms and conditions contained in this waiver and release of liability and I fully agree to comply with these terms.

Patrons who violate the rules of conduct may be immediately ejected from the park. Illegal behavior will immediately result in action by a Vallejo Police Officer. Failure to completely sign application will result in automatic rejection of exhibition/vending space. We agree that failure to achieve satisfactory on-site Fire Department inspections and/or failure to comply with the stated requirements are grounds for being excluded from participation in this and possibly future events with Phase1 Entertainment. We agree that fees already paid will not be refunded should our booth not satisfy the conditions stated in the Vendor Application and Information Attachments. I HAVE READ AND UNDERSTAND THE ATTACHED RULES, POLICIES AND PROCEDURES FOR THE PASKO EXPO FESTIVAL AND FULLY AGREE TO COMPLY WITH THESE TERMS.
